Welcome to ViralOps. By accessing or using our platform at vrlops.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using ViralOps, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

ViralOps is a marketplace platform that connects product builders ("Builders") with social media content creators ("Creators") for performance-based marketing campaigns on TikTok and Instagram.

3. User Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 18 years old to use the Service.
One person may not maintain more than one account per role.

4. Builder Terms

Campaign Funding

Builders fund campaigns via Stripe Checkout. Campaign budgets are held by ViralOps and distributed to Creators based on the campaign's compensation model. A 5% platform fee is applied on top of the campaign budget at checkout.

Compensation Models

Builders set compensation terms when creating a campaign (fixed fee per post, cost per view, and/or milestone bonuses). These terms cannot be changed after the campaign is funded.

Refunds

Unspent campaign budget may be refunded upon request after a campaign is marked as completed. Refund processing takes 5-10 business days. ViralOps reserves the right to withhold refunds in cases of suspected fraud.

5. Creator Terms

Content Submissions

Creators must submit genuine, original content that complies with the campaign brief and platform guidelines. Submissions must be posted on the Creator's own social media accounts.

Metric Tracking

ViralOps tracks post metrics (views, likes, comments, shares) to calculate earnings. Creators agree to connect their social accounts for metric verification.

Payouts

Creators receive payouts via Stripe Connect. The minimum payout threshold is $10.00. Creators receive the full advertised compensation rate — the platform fee is charged to Builders, not Creators.

6. Prohibited Conduct

Artificially inflating metrics (buying views, using bots, engagement pods)
Submitting content not created by or for the campaign
Creating multiple accounts to circumvent restrictions
Harassing, threatening, or abusing other users
Using the platform for illegal purposes

7. Platform Fee

ViralOps charges a 5% platform fee on all campaign spend. This fee is applied builder-side at checkout. Creators receive the full advertised rate.

8. Intellectual Property

Creators retain ownership of all content they create. By submitting content to a campaign, Creators grant the Builder a non-exclusive license to use the content for promotional purposes as described in the campaign brief.

9. Limitation of Liability

ViralOps is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount of fees you have paid to us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting support. Earned but unpaid Creator balances will be paid out upon account closure.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of Amsterdam, the Netherlands.
